Terms and Conditions for the Badger Planter App
Introduction:
The Badger Planters App (“the App”) is owned and operated by Badger Planters (“we”, “us”, “our”). These terms and conditions govern your use of the App, and by using the App, you agree to be bound by these terms and conditions.
Membership:
a. The App is a members-only service. Membership is granted at the sole discretion of Badger Planters.
b. We reserve the right to refuse membership to any applicant without providing any reason.
Use of the App:
a. By using the App, you agree to use it only for lawful purposes.
b. You agree not to use the App in a way that infringes the rights of any third party or that could be considered offensive, defamatory, or harmful.
c. You agree not to use the App for any illegal or unauthorized purposes, including but not limited to unauthorized access to our systems or data.

Intellectual Property:

c. You agree to indemnify and hold us harmless from any claims, losses, damages, or expenses (including reasonable legal fees) arising from your use of the App.
Amendments:

Governing Law:
a. These terms and conditions are governed by and construed in accordance with the laws of South Africa.
b. Any disputes arising out of or in connection with these terms and conditions will be subject to the exclusive jurisdiction of the courts of South Africa.

EULA
End User License Agreement (EULA) for Badger Planters App
Introduction:
This End User License Agreement (“EULA”) is a legal agreement between you (“User”, “you”) and Badger Planters (“we”, “us”, “our”) governing your use of the Badger Planters App (“the App”). By downloading, installing, or using the App, you agree to be bound by the terms and conditions set forth in this EULA. If you do not agree to these terms, do not install or use the App.
License Grant:
a. We grant you a limited, non-exclusive, non-transferable, and revocable license to use the App solely for personal and non-commercial purposes in accordance with this EULA.
b. This license does not grant you any ownership rights in the App, and the App remains the property of Badger Planters.
Restrictions on Use:
a. You may not modify, reverse engineer, decompile, or disassemble the App, except to the extent that such activity is expressly permitted by applicable law.
b. You may not sell, lease, rent, sublicense, distribute, or transfer the App or any rights to it to any third party.
c. You agree not to use the App for any purpose that is unlawful or prohibited by this EULA.
Intellectual Property:
a. All intellectual property rights in the App, including all content, features, and functionalities, are owned by or licensed to Badger Planters.
b. You agree not to remove, alter, or obscure any copyright, trademark, or other proprietary rights notices displayed within the App.

Updates and Modifications:

Termination:

c. We may terminate this EULA and your use of the App if you violate any terms of this EULA. Upon termination, you must cease all use of the App and delete any copies from your device.
Disclaimer of Warranties:
a. The App is provided on an “as is” and “as available” basis. We make no warranties, express or implied, regarding the App’s performance, reliability, or suitability for any purpose.
b. We do not guarantee that the App will be free from errors, bugs, or interruptions, or that any defects will be corrected.
Limitation of Liability:
a. To the maximum extent permitted by applicable law, we shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or related to your use of the App.
b. In no event will our total liability to you exceed the amount you paid, if any, for the App.
Governing Law:
a. This EULA is governed by and construed in accordance with the laws of South Africa.
